NEDLAC REVIEW – OUTSOURCING, SUB-CONTRACTING,
TEMPORARY EMPLOYMENT SERVICES (TES) & LABOUR LAW REVIEW
You will be familiar with the ANC election manifesto which promised to address the matters of
outsourcing, subcontracting and Labour Brokers. The Department of Labour has recently tabled a
discussion document at NEDLAC which proposes far-reaching amendments to certain labour laws and
the manner in which Temporary Employed Staff (TES) are to operate in the future.
Services SETA in conjunction with CAPES, invites you to attend a session which will focus
on the future Labour Law/ TES/ outsourcing landscape and dispensation, including:
While this is an event that is being arranged in conjunction with CAPES,
SERVICES SETA would like to extend an invitation to its registered members
that will be affected by the new legislation to engage and discuss the
documentation. Your responses and critiques of the documentation will be
consolidated and submitted to NEDLAC.
• TES – proposals regarding limited duration contracts, wages and employment
conditions, unionization, client liability, regulation and enforcement, probation,
equality and the like.
• Outsourcing and Sub-contracting – proposals in respect of regulating
exploitation and evasion of labour laws.
• General proposed amendments to the LRA and BCEA – CCMA processes, unfair
labour practices (benefits), transfer of businesses and services, section 189,
severance pay entitlements, and the like.
